terms of
service.
These terms govern your access to and use of BotScope — the observatory for AI visibility. They form a binding agreement between you and us, so please read them carefully. BotScope is built for business use; by using it you confirm you are acting in the course of a business, trade or profession.
- You can use BotScope to track how AI models represent brands and domains you are authorised to monitor — not to harass, impersonate, or spy on others.
- Plans are billed in US dollars through Stripe and renew automatically until you cancel. You can cancel anytime; access runs to the end of the period you have paid for.
- We report what third-party AI models say. We don't control those models and can't guarantee their output is accurate, complete, or stable over time.
- You own your watchlist data. We own the platform. We use only de-identified, aggregated data to improve the product.
- The service is provided "as is", and our liability is capped — see the full terms for the detail that actually governs.
This summary is for convenience only and is not part of the agreement. Where it differs from the full terms below, the full terms govern.

SECT.01 Agreement & who we are.
These terms of service (the "Terms") are entered into between you, or the organisation you represent ("you", "your" or "Customer"), and KOJI STUDIO LTD, which trades as "BotScope" and is referred to in these Terms as "BotScope", "we", "us" or "our".
These Terms, together with our Privacy Policy and any order, quote or plan selection you accept at sign-up or checkout (an "Order"), form the entire agreement between you and us for your use of the Service (the "Agreement"). By creating an account, starting a trial, purchasing a plan, or otherwise using the Service, you confirm that you accept these Terms and have authority to bind the organisation you represent.
If you do not agree to these Terms, you must not use the Service.
SECT.02 Definitions.
- Service — the BotScope platform, websites, dashboards, APIs, scans, reports and related services we make available at botscope.ai, app.botscope.ai and api.botscope.ai.
- Account — the account you create to access the Service, including any organisation, workspace and user seats within it.
- Watchlist — the brands, domains, entities and queries you configure for us to monitor.
- Credit — the unit by which usage is metered. One Credit equals one model query — a single query run against a single model on a single day.
- Customer Data — the data you submit to the Service, including your Watchlist configuration, queries, brand and domain inputs, and account details.
- Outputs — the scan results, scores, citations, comparisons and reports the Service generates for you.
- AI Providers — the third parties that operate the AI models the Service observes, as described in section 9.
SECT.03 The service.
BotScope is a measurement instrument for AI visibility. It runs queries against generative AI models, observes how those models represent the brands and domains on your Watchlist, and reports the results as scores, citations, comparisons and trends over time. The specific models, features and allowances available to you depend on the plan you select.
We are continually improving the Service. We may add, change, suspend or remove features, models or methodology at any time. We will try to avoid materially reducing core functionality of a paid plan during a period you have paid for, but the Service is provided on an evolving basis and not against any fixed specification.
We may make beta, preview or experimental features available. These are provided "as is", may be changed or withdrawn at any time, and are excluded from any service commitments.
SECT.04 Eligibility & accounts.
You must be at least 18 years old and acting on behalf of a business, trade or profession to use the Service. The Service is not offered to consumers, and you agree that consumer protection rules — including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — do not apply to this Agreement.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your Account, whether or not authorised by you. You must notify us promptly at [email protected] if you suspect any unauthorised access or use. You are responsible for the acts and omissions of any users you invite to your workspace, and for ensuring they comply with these Terms.
SECT.05 Acceptable use.
You may use the Service only for lawful business purposes and in accordance with these Terms. In particular, you agree that you will not, and will not permit anyone else to:
- add to a Watchlist, or otherwise monitor, any brand, domain, person or entity that you do not own or are not otherwise authorised or legitimately interested in monitoring;
- use the Service to harass, defame, impersonate, deceive, or unlawfully surveil any person or organisation;
- use the Service in any way that breaches the terms of service or acceptable-use policies of any AI Provider or other third-party platform;
- copy, scrape, resell, sublicense or commercially exploit the Service or its Outputs except as expressly permitted by your plan (for example, including Outputs in reports to your own clients under an agency plan);
- reverse engineer, decompile, or attempt to derive the source code, models or methodology of the Service, except to the extent this restriction is prohibited by law;
- probe, circumvent or interfere with the security, rate limits, billing or integrity of the Service, or access it other than through the interfaces we provide;
- upload or submit Customer Data that is unlawful, infringes a third party's rights, or contains malware or harmful code; or
- use the Service to build a competing product or to benchmark it for a competitor.
You are solely responsible for your Watchlist and for ensuring you have the right to monitor every target it contains. We may, but are not obliged to, review, limit or remove Watchlist entries or Customer Data that we reasonably believe breach this section.
SECT.06 Plans, credits & trials.
The Service is offered on credit-based plans. The plan, price, and Credit allowance applicable to you are those shown on our pricing page or your Order at the time of purchase. One Credit equals one model query, as defined above; a Watchlist of 20 queries scanned across 5 models each day therefore uses 100 Credits per day.
Credits included with a subscription are allocated for each billing period and, unless we state otherwise, do not roll over to the next period. One-off top-up Credits may be purchased and are consumed alongside your plan allowance. When your available Credits are exhausted, scans pause — we do not silently charge you for overage. You may upgrade your plan or top up Credits at any time from the billing dashboard.
We may offer a free trial. Trials are provided for evaluation only, may have reduced features or allowances, and may be changed or withdrawn at any time. We may limit trials to one per organisation and take reasonable steps to detect and prevent trial abuse. Data created during a trial may be deleted if you do not subscribe.
SECT.07 Fees, billing & tax.
Fees for paid plans are stated and charged in US dollars (USD) and are billed in advance through our payment processor, Stripe, Inc. By providing a payment method you authorise us and Stripe to charge it for all fees due under your plan, including renewals and any top-ups you purchase.
Fees are exclusive of taxes. Where we are required to charge value added tax (VAT), sales tax, goods-and-services tax or similar, the applicable amount is calculated and added at checkout (currently via Stripe Tax) and shown to you before you confirm payment. You are responsible for all such taxes other than taxes on our income. Where an annual discount is offered, it applies only to the plans and on the terms shown at checkout.
We may change our fees. For existing subscriptions, price changes take effect at the start of your next billing period, and we will give you reasonable advance notice. If a payment fails, we may retry it, and we may suspend or downgrade your Account until payment is made. All amounts are payable without set-off or deduction.
SECT.08 Renewal, cancellation & refunds.
Paid plans renew automatically at the end of each billing period — monthly or annual, as selected — at the then-current fee, until cancelled. You may cancel at any time from your billing dashboard; cancellation takes effect at the end of the current billing period, and you retain access until then.
Except where required by law, all fees are non-refundable, and there are no refunds or credits for partial billing periods, unused Credits, plan downgrades, or periods during which you did not use the Service. Because you are contracting as a business, no consumer cancellation or cooling-off rights apply.
SECT.09 Third-party AI models & accuracy.
The Service observes and reports on outputs generated by third-party AI models and systems, which may include those operated by OpenAI, Google, Anthropic, Microsoft, Perplexity and others ("AI Providers"). We are independent. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of any AI Provider, and their names and trademarks belong to them and are used only to identify their services.
AI outputs are probabilistic. They vary between runs, change over time, and may be inaccurate, incomplete, outdated or biased. We aggregate observations — for example using medians across runs, models and prompts — to make results more robust, but we do not warrant the accuracy, completeness or reproducibility of any AI Provider's output, and we are not responsible for the availability, behaviour or terms of any AI Provider. The Service may be affected if an AI Provider changes, restricts or withdraws access to its models.
Outputs are provided for informational purposes only. They are not professional, legal, financial, or marketing advice, and you are responsible for any decisions you make based on them.
SECT.10 Intellectual property & licences.
As between you and us, we and our licensors own all intellectual property rights in the Service, including the platform, software, the Observatory design system, our methodology, and all data we generate that is aggregated or de-identified. We grant you a non-exclusive, non-transferable, revocable right to access and use the Service during your subscription, solely for your internal business purposes and in accordance with these Terms.
You retain all rights in your Customer Data. You grant us a worldwide, non-exclusive licence to host, store, process and use Customer Data as needed to operate and provide the Service to you. You grant us a licence to use Outputs we generate for you for your internal business purposes and, where your plan permits, in reporting to your own clients.
We may use de-identified and aggregated data derived from use of the Service to operate, secure, benchmark and improve our products. Such data never identifies you or your clients. If you give us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without restriction or obligation to you.
SECT.11 Data protection.
Our handling of personal data is described in our Privacy Policy. Each party will comply with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018. We act as a controller in respect of account and billing data we collect to run our business.
To the limited extent that Customer Data contains personal data that we process on your behalf, we act as a processor on your documented instructions, and a data processing addendum is available on request from [email protected]. You are responsible for ensuring you have a lawful basis to submit any personal data you include in Customer Data.
SECT.12 Confidentiality.
Each party may receive confidential information of the other in connection with the Agreement. Each party will use the other's confidential information only to perform under the Agreement, will protect it with reasonable care, and will not disclose it except to those who need to know it and are bound by similar obligations. This does not apply to information that is public through no fault of the receiving party, independently developed, or required to be disclosed by law.
SECT.13 Availability & disclaimers.
We aim to keep the Service available and reliable, but it is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied terms, conditions, warranties and representations, including as to satisfactory quality, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure or error-free, that scans will run on any particular schedule, or that Outputs will be accurate, complete or fit for any purpose. We may carry out maintenance, and may need to suspend the Service to do so. Any service-level commitments apply only where expressly agreed in writing with Enterprise customers in a separate Order or SLA.
SECT.14 Limitation of liability.
Nothing in these Terms limits or excludes either party's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
Subject to that, and to the fullest extent permitted by law:
- we are not liable for any indirect, special or consequential loss, or for loss of profits, revenue, business, goodwill, anticipated savings, or loss of or corruption of data, in each case whether arising in contract, tort (including negligence), or otherwise, even if foreseeable; and
- our total aggregate liability arising out of or in connection with the Agreement is limited to the total fees you paid to us in the 12 months immediately before the event giving rise to the claim. Where no fees were paid (for example, during a free trial), our total aggregate liability is limited to USD 100.
You acknowledge that the Service reports on third-party AI outputs that we do not control, and that we are not liable for any AI Provider's output or for decisions you make in reliance on Outputs.
SECT.15 Indemnity.
You will indemnify us against all losses, damages, liabilities and reasonable costs (including legal fees) we incur arising from: (a) your breach of section 5 (Acceptable use); (b) your use of the Service to monitor any brand, domain, person or entity you are not authorised to monitor; (c) Customer Data that infringes a third party's rights or breaches applicable law; and (d) any breach by you of an AI Provider's terms through your use of the Service.
SECT.16 Suspension & termination.
You may stop using the Service and cancel your subscription at any time as described in section 8. We may suspend or terminate your access, in whole or in part, if you breach these Terms, fail to pay fees when due, or if we reasonably believe your use poses a legal, security or reputational risk to us or others. Where practical and lawful, we will give you notice and an opportunity to remedy a breach first.
On termination, your right to use the Service ends and any outstanding fees become due. We will make your Customer Data available for export for a reasonable period (normally 30 days) after termination, after which we may delete it in the ordinary course, subject to our legal retention obligations and our Privacy Policy. Any terms that by their nature should survive termination — including sections 9 to 15, 19 and 20 — will survive.
SECT.17 Changes.
We may update these Terms from time to time. If we make a material change, we will give you reasonable notice — by email to your account address, or by a notice in the Service or on our website — before it takes effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to a change, you must stop using the Service and may cancel under section 8.
SECT.18 General.
- Entire agreement. The Agreement is the entire agreement between us on its subject matter and supersedes any prior discussions. Neither party has relied on any statement not set out in the Agreement.
- Force majeure. Neither party is liable for failure or delay caused by events beyond its reasonable control, including outages or changes at AI Providers or other infrastructure suppliers.
- Assignment. You may not assign or transfer the Agreement without our written consent. We may assign it to an affiliate or in connection with a merger, acquisition or sale of assets.
- Waiver & severability. A failure to enforce a term is not a waiver of it. If any term is found unenforceable, the rest remain in force.
- No partnership. Nothing in the Agreement creates a partnership, agency or employment relationship between the parties.
- Third parties. A person who is not a party to the Agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
- Notices. Legal notices to us should be sent to [email protected]; we will send notices to the email address on your Account.
SECT.19 Governing law & jurisdiction.
The Agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
